This Boat Rental Agreement, Liability Waiver, and Release of Liability ("Agreement") is entered into between MC Liquid Assets ("Owner," "Company"), located in Washington, Utah, and the undersigned renter ("Renter"). This Agreement governs the rental of the 2011 MasterCraft X45, Hull ID #[VESSEL-ID], hereinafter referred to as "the Vessel." By signing this Agreement, Renter agrees to all terms and conditions herein.

The rental period begins at the scheduled check-in time and ends at the scheduled return time as selected by Renter during booking ("Rental Period"). Renter agrees to return the Vessel at the designated return location — Sand Hollow State Park Launch Ramp, Washington, Utah — on time. Late returns are subject to fees of $150 per hour or any portion thereof, charged automatically to the credit card on file.

Renter agrees to use the Vessel solely for lawful recreational purposes on approved waterways. The Vessel is approved for use at: Sand Hollow Reservoir, Quail Creek Reservoir, Gunlock Reservoir, and other Utah lakes with prior written approval. Use at Lake Powell, Lake Mead, or other out-of-state locations requires advance written authorization from Owner.

Only the named Renter, age 21 or older, may operate the Vessel. Renter must possess a valid government-issued driver's license. Pursuant to Utah State Code § 73-18-14, anyone born after December 31, 1986 must hold a valid Utah Boater Education Certificate or equivalent from another state to legally operate a motorized vessel. If Renter does not possess the required certification, a licensed captain add-on is mandatory and non-negotiable.

The following are strictly prohibited:

1. Operating the Vessel while under the influence of alcohol, marijuana, or any controlled or impairing substance (including prescription medications that impair judgment)
2. Allowing any unauthorized person (not the named Renter) to operate the Vessel
3. Exceeding maximum capacity of 18 passengers
4. Operating before sunrise or after sunset, or in conditions of reduced visibility including fog, heavy rain, or smoke
5. Operating in restricted areas, no-wake zones at improper speed, or in violation of any posted marina or park rules
6. Using the Vessel for commercial purposes, compensation, or hire of any kind
7. Permitting persons under the influence of alcohol or drugs to board the Vessel
8. Wake jumping behind other watercraft or engaging in reckless operation
9. Removing the Vessel from the water or trailering it to a different location without prior written Owner approval
10. Transporting live or invasive species between water bodies (Utah law)
11. Discharging any waste, fuel, or pollutants into the water
12. Using the Vessel in any professional video production or commercial shoot without a signed commercial use addendum

The rental rate is as selected at booking. A non-refundable $200 booking deposit is required to hold the reservation and is applied toward the total rental fee. The remaining balance is due at check-in before the Rental Period begins.

A security hold of $1,500.00 ("Security Deposit") will be placed on Renter's credit card at time of check-in. This hold is not a charge — it is an authorization. The Security Deposit will be released in full within 3–5 business days following the return of the Vessel, subject to: (a) the Vessel being returned on time; (b) the Vessel being returned with the same fuel level as at departure; (c) no damage beyond normal wear having occurred; and (d) no violations of this Agreement having occurred during the Rental Period.

Fuel is not included in the rental price. Renter is responsible for returning the Vessel with the same fuel level as shown on the gauge at the start of the Rental Period. If the Vessel is returned with less fuel, Owner will charge the Renter $8.50 per gallon to refill to the departure level. Renter is encouraged to keep fuel receipts for any refueling during the Rental Period.

Renter is fully and solely responsible for all damage to the Vessel, its motor, equipment, trailer, and accessories caused during the Rental Period, including damage caused by Renter, Renter's guests, or any third party as a result of Renter's operation of the Vessel. Damage includes but is not limited to: hull damage, propeller damage, damage to ballast systems, tower, electronics, upholstery, and safety equipment. Full repair costs will be charged to Renter's credit card on file.

48+ hours before rental: Full refund of deposit minus a 5% payment processing fee. Less than 48 hours before rental: $200 deposit is fully forfeited. No exceptions except documented medical emergencies with written documentation. No-Show: Full deposit forfeited. Renter may be charged for the full rental value if the slot could not be re-rented. Weather cancellations initiated by Owner: Full deposit refund or free reschedule, Renter's choice.

Renter agrees to inspect the Vessel with an Owner representative prior to departure and acknowledge its condition on the check-in form. Any pre-existing damage noted at inspection will not be charged to Renter. Failure to report existing damage prior to departure constitutes acceptance of the Vessel in good condition and creates liability for any subsequently discovered damage.

Renter agrees to return the Vessel in the same condition as received, ordinary splashing and water contact excepted. The following will incur cleaning fees of $75–$150: excessive food, sunscreen, or waste left in the boat; fish or bait debris; mud or sand in the bilge or carpet beyond normal use; vomit or other bodily fluids.

In the event of a mechanical breakdown or malfunction during the Rental Period, Renter shall immediately stop the Vessel, contact Owner at (435) 555-0190, and await instructions. Continued operation of a malfunctioning vessel shifts all liability for further damage and personal injury to Renter. Owner will not provide refunds for time lost due to Renter-caused mechanical issues. Owner will provide a pro-rated refund for time lost due to verified mechanical failures not caused by Renter misuse.

Owner provides U.S. Coast Guard-approved Type II or Type III life jackets for all passengers. Renter agrees that: (a) Any child under 13 years of age must wear a life jacket at all times while on board; (b) All persons must wear a life jacket while swimming from the anchored Vessel; (c) Renter will enforce life jacket use at their discretion for all other passengers; (d) Renter will conduct a basic safety briefing with all passengers before departure. Owner's staff will conduct a full vessel orientation at check-in.

Renter acknowledges that the use of a motorized watercraft and all water sports activities conducted from or behind the Vessel (including but not limited to wake surfing, wakeboarding, water skiing, tubing, swimming, and cliff jumping) involve INHERENT RISKS of serious personal injury, permanent disability, and death. These risks include but are not limited to:

1. Collision with other watercraft, stationary objects, docks, rocks, or underwater obstacles
2. Falls from the Vessel or towed equipment at speed
3. Drowning, submersion, or inability to surface
4. Propeller strikes and lacerations from rotating machinery
5. Impact injuries from wake surf boards, wakeboards, ropes, and tow equipment
6. Neck, spinal, and head injuries from impacts with water or other surfaces
7. Hypothermia, heat exhaustion, or sun exposure
8. Equipment failure including motor, steering, or ballast systems
9. Sudden changes in weather conditions including lightning, wind, and waves
10. Animal and insect hazards in or around the water

IN CONSIDERATION of being permitted to rent and operate the Vessel, Renter, on behalf of themselves, their heirs, personal representatives, assigns, and all members of their party, hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE MC Liquid Assets, its owners, officers, employees, agents, representatives, successors, assigns, and insurers (collectively, "Released Parties") from ALL LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION, COSTS, AND EXPENSES of any kind arising from or related to: (a) Renter's use of the Vessel; (b) any water sports activities conducted during the Rental Period; (c) any property damage or personal injury, including death, sustained by Renter or any member of Renter's party during the Rental Period — EVEN IF SUCH INJURY OR DAMAGE IS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES.

Renter agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (a) any damage to third-party property or personal injury to third parties caused by Renter's operation of the Vessel; (b) any violation of this Agreement by Renter; (c) any claims by members of Renter's party arising from the Rental Period; (d) any fines, penalties, or citations issued to Owner as a result of Renter's conduct.

Renter is solely responsible for any damage to third-party property, personal injury to third parties, or damage to other watercraft caused during the Rental Period. Renter agrees to maintain liability coverage (via either the Damage Waiver or their own watercraft insurance policy) adequate to cover third-party claims. Owner shall not be responsible for any third-party claims arising from Renter's operation of the Vessel.

This Agreement shall be governed by the laws of the State of Utah. Any dispute arising under this Agreement shall be resolved exclusively in the courts of Washington County, Utah. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire understanding between the parties and supersedes all prior negotiations.

RENTER ACKNOWLEDGES THAT THEY HAVE READ THIS ENTIRE AGREEMENT, UNDERSTAND ITS TERMS, AND ARE SIGNING IT VOLUNTARILY. RENTER UNDERSTANDS THAT BY SIGNING THIS AGREEMENT THEY ARE WAIVING IMPORTANT LEGAL RIGHTS INCLUDING THE RIGHT TO SUE IN THE EVENT OF INJURY, DEATH, OR PROPERTY DAMAGE.
